For You

Our Legal Services For You

Throughout our lives, we encounter obstacles, or circumstances that push us to seek legal advise. We can help you to find common-sense, practical, and cost-effective solutions to whatever your circumstances. If you’re looking for a solicitor in the Cirencester or Gloucester area all you need to do is give us a call.

When working with us, you can relax knowing that your affairs are all in order. Come and visit us in our Cirencester or Gloucester offices, or we can come to you. Find out more about our legal services for you.

Residential Property

Moving house is said to be one of life’s most stressful events. To avoid last minute holdups or delays, particularly if you’re in a chain, you need your solicitor to complete the legal steps promptly and keep you up to date with what’s going on. You can be sure that our experienced team will guide you through the paperwork, ensuring that you understand the property title and search results and know exactly what you’re signing.

Wills

A Will is essential if you have children or other dependants who may not be able to care for themselves, providing certainty about who will look after or provide for them if you die. We can draft documents that allow you to have your say and pass responsibility for their care to someone you trust.

Inheritance Tax Planning

It is never too early to think about estate planning however if you born before 1970 now is the time to really start planning. Prudent estate planning utilises statutory exemptions, allowances and reliefs. It is also sensible to get financial advice on how best to ensure that your pensions and other assets are able to pass to your beneficiaries in a tax efficient way. We can advise and guide you on the best way to manage your estate.

Trusts & Lifetime Planning

It is never too early to think about estate planning however if you born before 1970 now is the time to really start planning. Prudent estate planning utilises statutory exemptions, allowances and reliefs. It is also sensible to get financial advice on how best to ensure that your pensions and other assets are able to pass to your beneficiaries in a tax efficient way. We can advise and guide you on the best way to manage your estate.

Probate & Estate Administration

When someone dies, their property and financial affairs must be wound up and their estate distributed to their beneficiaries. In estates of £5,000 or less, assets can usually be released directly to the personal representatives without the need for a probate application. Appointing us to deal with the estate will ensure that the process runs as smoothly as possible, and that tax and other allowances are taken fully into account.

Powers of Attorney

If you are unable to make decisions for yourself because of an accident or illness, a Lasting Power of Attorney (LPA) allows a person you trust to make decisions for you. Many assume that family and friends can make such decisions, only to find they have limited legal authority. There are various types of LPA you can appoint, from a Property and Affairs LPA, to a Personal Welfare LPA. We can draft documents that keep you in control and enable you to pass responsibility to someone you trust.

Court of Protection & Deputyships

The Court of Protection deals with the management of property and financial affairs, and health and welfare decisions of people who have difficulty or lack capacity themselves. The Court of Protection makes decisions about money, property, health or welfare and If decisions need to be made on an ongoing basis the Court gives these powers to someone else. We can provide legal advice about what options are available and whether a Court application is suitable.

Elderly Client Care

As we age our ability to deal with our finances and other affairs often diminishes yet the complications of these often become more complex. We specialise in helping vulnerable and elderly clients with their affairs. Our client’s often have complex personal situations. We offer careful, considerate and confidential attention. We will help you to find effective solutions and ensure peace of mind for you and your family.

Dispute Resolution

Typically, disputes can be dealt with quickly and resolved without too much difficulty or expense, but when disputes become more serious, they can also become costly, time-consuming and upsetting. When problems arise, an early discussion can help you to resolve disputes, often out of court, quickly and efficiently, minimising stress, legal expense and unnecessary risk.

Contentious Probate & Inheritance Disputes

The death of a loved one is always distressing. Problems can arise when people don’t receive what they expected.  Will challenges and claims can be extremely stressful. If you have any concerns about a loved one’s Will or you are currently disputing the validity of a Will we can review the Will and try to establish whether or not it is valid. If we can prove that the Will is invalid we can support you through the dispute.

Clinical Negligence

It’s distressing enough to need medical treatment. It’s even more distressing if the people treating you have been negligent. A medical error can lead to long-term misery and result in financial as well as physical consequences. You can expect honest, relevant and straightforward advice, and the reassurance of continuing support. We make claims simple. We will keep you informed every step of the way and explain the process to you.

Personal Injury Claims

Sadly, nothing can change what has happened to you, but we can give you the best legal advice to help you access early rehabilitation and do our best to secure a compensation award that will support your long-term recovery. Wherever possible we will secure interim payments. These can help with care, aids, equipment, therapies and visits by loved ones, which can be an invaluable part of the rehabilitation process.

Your Family

Our Legal Services For Your Family

We know that family is important and at times you have to do things to sort out a dispute or protect them in the future. You may be intending to marry and would like to know more about a pre-nuptial agreement. You may be married already and are considering entering into a post-nuptial agreement. You may be buying a family home or need to make a Will. You might be planning for your future or the future of an elderly friend or relative. Or you might be dealing with an estate after a bereavement.

Whatever your concern, we aim to make the solution as straightforward and stress-free as possible. If you’re looking for a solicitor in the Cirencester or Gloucester area all you need to do is give us a call.

When working with us, you can relax knowing that your affairs are all in order. Come and visit us in our Cirencester or Gloucester offices, or we can come to you. Find out more about our legal services for your family.

Divorce and Dissolution

Divorce or dissolution does not have to be complicated and it is not usually necessary to attend court. Generally the process will take a minimum of five months but we would ordinarily advise that the final decree should not be obtained until such time as the parties’ financial situation has been resolved. We aim to make the divorce process as simple and painless as possible, each case is handled with skill and sensitivity.

Collaborative Family Law

Collaborative Family Law is a way for divorcing or separating couples to resolve the issues arising on family breakdown, working together with their Lawyers and without going to court. The process is designed to negotiate mutually acceptable outcomes, without using the court, with the clients sharing information and communicating openly with each other.

Domestic Abuse

Abuse can be physical, psychological, sexual, financial or emotional and it includes the threat of abuse. If you are the victim of domestic abuse and you have children it is vitally important that you take steps to protect them. If you are unfortunate enough to suffer from or if you have been threatened with domestic abuse, we can advise you on steps to protect you, and your family.

Finances

The breakdown of a marriage or Civil Partnership is difficult enough to deal with without having to worry about finances. Often people decide that they do not wish to deal with financial issues, believing time will sort everything out. This is not the case and in fact it is vitally important that finances are dealt with. Davey Law will provide you with the expert advice you need to resolve your financial affairs, whatever your financial position.

Costs

We have a range of options that can help you budget and plan accordingly and we will always agree costs and fees in advance with you so that there are no “nasty surprises”. Our aim is to be transparent about our costs so that you know exactly what to expect. If your income is lower than that of your spouse or partner, it may be possible to agree that he or she contributes towards your costs.

Children

Issues surrounding children can be difficult and painful for separating parents. In all but the rarest of cases, however, children will still have contact with the parent who does not have the day-to-day care of them so the parents will have some contact with each other. If you are having problems, please do not delay in seeking advice. In most cases, the longer you leave matters, the more difficult it will be to rectify them.

Child Support

Child support is an on-going obligation and is not linked to marital status, parental responsibility or contact with children. Child support is often referred to in financial orders for divorcing couples and if it is, this precludes the involvement of the Statutory Child Maintenance Service for a year unless other provisions which specifically deal with continuing child support are made.

Living Together

Every day people make the huge decision to move in with their partners or buy a home together, but few couples consider their legal position until it is too late. It is a prevalent misconception that in the UK cohabiting couples carry some legal status often described as ‘common law marriage’. At Davey Law we apply our experience to ensure that you have considered and understand everything you need to know about living together.

Pre & Post Nuptial Agreements

At present pre-nups are not fully recognised as legally binding by the courts but a pre-nup can help avoid long and acrimonious litigation on breakdown. They are therefore a very useful means of defining the parties separate property and their entitlement to any agreement to divide or ring fence assets, if there is a divorce or dissolution later. Davey Law’s experienced family lawyers can advise you on the pros and cons of entering a pre-nup or post-nup.

Our Court of Protection Solicitors can provide legal advice about whether a Court application is suitable.

Michael Brady

Solicitor, Director

Michael Brady, based at our Cirencester office, is an experienced litigator and family law solicitor and a member of the Law Society’s specialist Family Law Panel.

His family work includes divorce and cohabitation breakdown, especially the resolution of financial issues, as well as issues with access to and care of children, in which he has experience of acting on behalf of both parents and local authorities.

Michael joined the firm in 2005 and believes strongly in a conciliatory approach to family law work and in seeking practical solutions to often complex family problems. He is a strong supporter of collaborative law, a modern and dignified way of resolving family issues without involving the courts.

Michael also advises on employment and civil litigation matters including compromise agreements, employment tribunal cases, commercial and general disputes. His work often involves advising employers on pre-emptive measures to avoid future tribunal claims, to include audits of HR and employment policies, systems and staff handbooks.

Michael is married with 2 children and is a keen follower of England’s cricket roller-coaster!

“I would like to thank everyone from the receptionist to Mr Brady himself for their professional but friendly service”

“Michael Brady was very helpful and I was very satisfied with your service. Thank you.”
