In estates of £5,000 or less, assets can usually be released directly to the personal representatives without the need for a probate application. Divorce or dissolution does not have to be complicated and it is not usually necessary to attend court. Generally the process will take a minimum of five months but we would ordinarily advise that the final decree should not be obtained until such time as the parties’ financial situation has been resolved. Children

Child support is an on-going obligation and is not linked to marital status, parental responsibility or contact with children. Child support is often referred to in financial orders for divorcing couples and if it is, this precludes the involvement of the Statutory Child Maintenance Service for a year unless other provisions which specifically deal with continuing child support are made.

Michael Brady
Solicitor, Director
Michael Brady, based at our Cirencester office, is an experienced litigator and family law solicitor and a member of the Law Society’s specialist Family Law Panel.
His family work includes divorce and cohabitation breakdown, especially the resolution of financial issues, as well as issues with access to and care of children, in which he has experience of acting on behalf of both parents and local authorities.
Michael joined the firm in 2005 and believes strongly in a conciliatory approach to family law work and in seeking practical solutions to often complex family problems. He is a strong supporter of collaborative law, a modern and dignified way of resolving family issues without involving the courts.
Michael also advises on employment and civil litigation matters including compromise agreements, employment tribunal cases, commercial and general disputes. His work often involves advising employers on pre-emptive measures to avoid future tribunal claims, to include audits of HR and employment policies, systems and staff handbooks.
Michael is married with 2 children and is a keen follower of England’s cricket roller-coaster!
