The death of a loved one is always distressing. Problems can arise when people don’t receive what they expected.  Will challenges and claims can be extremely stressful.

Under the Inheritance (Provision for Family and Dependants) Act 1975, legal protection is available for spouses, children and other dependents where a person has died without leaving sufficient money for their continued wellbeing. If you feel that you may be entitled to make a claim against an estate contact our experts.  Factors that the Court will consider when dealing with Inheritance Act claims include:

  • The financial needs of the person making the claim
  • The financial needs of any beneficiary of the estate
  • The responsibilities the deceased had with regard to the person making the claim, or to any beneficiary of their estate

  • Any disability, mental or physical, of the person making the claim, or any existing beneficiary of the estate
